Assumed Names/Co-Partnerships

Guide to Starting and Operating a Small Business

Sole proprietorships and co-partnerships file certificates of assumed name and certificates of co-partnership with the county clerk in the counties in which they transact business if the business operates under a name other than the individual’s name.

A business name is subject to approval of the County Clerk. The proposed name of the Assumed Name or Co-Partnership may not be available if a name the same or similar is already on file in the county. Business names must be distinguishable by name or by service.

 

 Certificate of Person(s) Conducting Business Under Assumed Name 

Filing fee is $10.00 (cash, checks, money orders only, no credit card)
Filing is valid for 5 years from date of acceptance by County Clerk

For your convenience (if filing by mail), you may download (three copies required) and complete the Certificate of Person(s) Conducting Business Under Assumed Name form. Please print on legal sized paper.

If filing by mail, please print clearly in ink and complete the following on the form:

-Print name of business.
-Print complete address of business (Post office boxes are not acceptable).
-Print full name and address of person(s) owning, conducting or transacting business.
-Signature(s) must be witnessed by a Notary Public.

All three copies are to be delivered to the Bay County Clerk's office. At that time, the document will be reviewed and the proposed business name will be researched for availability. If the proposed business name is available, the payment will be processed and the Certificate of Person(s) Conducting Business Under Assumed Name will be accepted for issuance. If you apply by mail, please include a self addressed stamped envelope so we may return your copies and receipt of payment.

Certificate of CoPartnership
